Diora Wellbeing's terms and conditions

Terms and conditions (T&C) of Diora Wellbeing, Dettergasse 5/24, 1160 Vienna, Austria

Scope of application
- These terms and conditions (T&C) are for all services, offerings, and products by Diora Wellbeing. By booking a session, course, workshop or event, a contract between Diora Wellbeing and the customer is concluded.
Types of offerings and services
- Individual sessions
  - Individual coaching sessions, somatic healing sessions, introductory workshops, and bespoke wellbeing sessions are single sessions with set prices that can be booked and consumed individually via one-time purchases or session bundles. There is no course retention, and sessions are offered according to the available time slots in the main schedule.
  - Individual sessions are limited to one participant and not transferable.
- Group sessions
  - Group sessions are single sessions with set prices that can be booked and consumed individually via one-time purchases, single tickets, session passes, or memberships. There is no course retention, and sessions are offered according to the current group session schedule.
  - Group sessions are open sessions for up to 99 participants.
- The above-mentioned offerings and services (individual sessions and group sessions) are available for booking via Diora Wellbeing’s online scheduling provider, Acuity Scheduling, which is part of Squarespace, and which uses Stripe as a payment provider.
- Corporate services
  - Corporate services encompass corporate consulting services, ideation workshops, team workshops, leader workshops, and wellbeing speaking engagements. The workshops have set lengths and prices, while the consulting services and speaking engagements are tailored services. Scope and costs will be agreed upon by Diora Wellbeing and the client.
Types of payments, products, and contracts
- One-time purchases
  - One-time purchases are standalone payments directly linked to the booking of one (1) specific group session or one (1) specific individual session.
    - Valid for: specific session booked
    - Not transferable
    - No automatic renewal
    - Courses and events are excluded
- Session passes
  - Session passes (such as 5-session passes or 10-session passes) are valid for a certain number of group sessions.
    - Valid from: Date of purchase
    - Valid for: 12 months
    - Not transferable
    - No automatic renewal
    - Individual coaching sessions, somatic healing sessions, introductory workshops, and bespoke wellbeing sessions as well as courses and events are excluded
  - Unconsumed units expire after pass expiration date.
- Session bundles
  - Session bundles are valid for a certain amount of minutes’ worth of individual sessions, including coaching sessions, somatic healing sessions, introductory workshops, and bespoke wellbeing sessions.
    - Valid from: Date of purchase
    - Valid for: 12 months
    - Not transferable
    - No automatic renewal
    - • Group sessions as well as courses and events are excluded
  - Unconsumed units expire after pass expiration date.
- Gift vouchers
  - Gift vouchers come in different amounts of Euros (10-Euro voucher, 25-Euro voucher, 50-Euro voucher, etc.) and can be redeemed for any type of service, including all group sessions, all individual sessions, and all corporate services.
    - Valid from: Date of purchase
    - Valid for: 36 months
- Courses and events
  - Courses and events are time-limited, standalone offers with set dates and separate booking modalities. They cannot be booked with the above-mentioned products.
Participation eligibility, rights & conduct
- Participation is only allowed for the person who made the booking. Individual sessions and group sessions are not transferable.
- Customers have to comply with the following rules of conduction when attending any given session, course, workshop, or event by Diora Wellbeing:
  - Customers agree to conduct themselves in a manner which allows for seamless conduction of any given session, course, workshop, or event and does not disrupt or hinder the teacher or any of the other participants.
  - Any forms of abuse, insult, threat, harassment, and hate speech are not tolerated and will result in permanent expulsion.
- Diora Wellbeing retains the right to refuse any further provision of service (without giving reasons). In such a case, any booked but unconsumed services will be refunded.
Changes and cancellations by Diora Wellbeing
- Individual sessions
  - Diora Wellbeing retains the right to cancel any individual coaching session, somatic healing session, introductory workshop, or bespoke wellbeing session, especially in case of illness of the provider or force majeure.
    - Notice of cancellation: at least 2 hours before start of the session
    - The customer will be notified via email
    - The customer will receive a refund and/or can book a different date/time.
  - Diora Wellbeing retains the right to change the date and time of any individual coaching session, somatic healing session, introductory workshop, or bespoke wellbeing session, especially in case of illness of the provider or force majeure.
    - Notice of intent to change: at least 2 hours before start of the session
    - The customer will be notified via email
    - If no alternative date/time can be found, the customer will receive a refund.
- Group sessions
  - Diora Wellbeing retains the right to cancel any group session, especially in case of illness of the provider or force majeure.
    - Notice of cancellation: at least 2 hours before start of the session
    - The customer will be notified via email
    - The customer will receive a refund and/or can book a different date/time.
Changes and cancellations by participants
- Individual sessions
  - Participants can cancel or request to change the date/time of any individual coaching session, somatic healing session, introductory workshop, or bespoke wellbeing session up until 2 hours before start of the session. After that, or in case of a no show, the full amount will be charged.
  - Exception: in case of sudden illness or injury, a last-minute cancellation or re-booking for an alternative date/time can be made, if a valid doctor’s note or other form of suitable proof can be submitted.
  - All such notifications have to be sent via email to estherdiora@outlook.com.
- Group sessions
  - Participants can cancel any group session free of charge up until 2 hours before start of the group session. After that, or in case of a no show, the unit counts as consumed.
- individual coaching sessions, somatic healing sessions, introductory workshops, bespoke wellbeing sessions as well as group sessions are only possible via Diora Wellbeing’s online scheduling provider, Acuity Scheduling, which is part of Squarespace.
Prices and payment modalities
- All prices are in Euros. Due to the Austrian Small Business Regulation, Diora Wellbeing is currently exempt from VAT Sales tax, so all prices are net value without VAT (umsatzsteuerfrei aufgrund der Kleinunternehmerregelung (§ 6 Abs. 1 Z 27 UStG 1994)).
- All offerings, services, products, and contracts related to individual sessions and group sessions are available for booking and purchase via Diora Wellbeing’s online scheduling provider, Acuity Scheduling, which is part of Squarespace, and which uses Stripe as a payment provider.
- Refunds, where applicable, will be issued within 5 working days and in any event no later than 14 calendar days after the customer informs Diora Wellbeing that they wish to cancel or withdraw.
Right of withdrawal
- If a consumer is based within the European Union, they have a statutory right to a “cooling off” period. This period begins upon conclusion of the contract between Diora Wellbeing and the consumer and ends at the end of 14 calendar days after that date. If the consumer changes their mind about the services within this period and wishes to cancel their contract, they can do so via email to estherdiora@outlook.com.
- A consumer’s right to withdraw during the cooling off period is subject to the provisions of the sub-clause below:
- If the services are to begin within the cooling off period, the consumer is required to make an express request to that effect. By requesting that the services begin within the 14-calendar-day cooling off period, the consumer acknowledges and agrees to the following:
  - If the services are fully performed within the 14-calendar-day cooling off period, the consumer will lose their right to withdraw after the services are complete.
  - If the consumer cancels the purchase after provision has begun but is not yet complete, the consumer will still be required to pay for the services supplied up until the point at which they inform Diora Wellbeing that they wish to withdraw. The amount due shall be calculated in proportion to the full price of the services and the actual services already provided. Any sums that have already been paid for the services shall be refunded subject to deductions calculated in accordance with the foregoing.
- Cancellation of purchases after the 14-calendar-day cooling off period has elapsed shall be subject to the specific terms governing those services.
- Refunds, where applicable, will be issued within 5 working days and in any event no later than 14 calendar days after the customer informs Diora Wellbeing that they wish to withdraw.
State of health
- Participants state that they are physically, mentally, and emotionally able to participate and practice. Any and all offerings and services cannot and do not replace professional support, medical or otherwise, and can merely be seen as additional and complementary services.
Applicable law and place of jurisdiction
- These terms and conditions shall be governed by Austrian law. Mandatory consumer protection laws of your country of habitual residence may remain unaffected and continue to apply.
